3. User Responsibilities

Account Creation and Security

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

5. Payment and Fees

6. Cancellation and Refund Policy

You may cancel scheduled coaching sessions with at least 24 hours notice. Cancellations made with less than 24 hours notice may not be eligible for rescheduling or refund. Refund requests will be evaluated on a case-by-case basis in accordance with our refund policy.

7. Limitation of Liability

To the fullest extent permitted by law, MasteryThrive and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to use our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall MasteryThrive's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to MasteryThrive in the twelve (12) months prior to the claim.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

• Our services will meet your specific requirements
• Our services will be uninterrupted, timely, or error-free
• The results obtained from using our services will be accurate
• Any errors in our services will be corrected

9. Professional Relationship

The relationship between MasteryThrive coaches and clients is strictly professional. Our coaching services are designed to facilitate career development and transition, but do not constitute therapy, psychological counseling, or mental health services. If you require mental health support, we recommend consulting with a licensed mental health professional.

10. Confidentiality

We respect the confidential nature of our coaching relationships. Information shared during coaching sessions will be kept confidential, except where:

• You provide written consent to disclose information
• Disclosure is required by law
• There is an imminent risk of harm to you or others

11. Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by MasteryThrive. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that MasteryThrive shall not be responsible for any damage or loss caused by use of such third-party resources.

You agree to defend, indemnify, and hold harmless MasteryThrive and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms of Use, or your violation of any rights of another.

13. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising from these terms shall be resolved through binding arbitration in New York, NY, in accordance with the rules of the American Arbitration Association.
